By accessing flvisual.com (“Site”) and placing an order with FL Visual LLC (“FL Visual,” “Company,” “we,” “us,” or “our”), you agree to these legally binding Terms & Conditions.

FL Visual is an independent, rider-built, aftermarket performance graphics company based in Arizona serving riders, racers, and professional teams worldwide.

1. Custom Manufacturing & Final Sale Policy

All products are custom manufactured upon order.

By placing an order, you acknowledge and agree that:

All products are made-to-order
Orders enter production shortly after purchase
Orders cannot be canceled once production begins
Custom products are FINAL SALE

This policy is consistent with our Shipping & Returns Policy.

2. Customer Responsibility

Customers are solely responsible for:

Selecting the correct brand, model, and year
Verifying compatibility before purchase
Reviewing order details before submission
Providing accurate billing and shipping information
Ensuring proper installation

Orders placed with incorrect information are not eligible for refund.

3. Aftermarket Product Disclaimer

FL Visual products are independent aftermarket graphics kits.

They are not OEM parts and are intended for customization and aesthetic enhancement only.

Installation is performed at the customer’s discretion and risk.

4. No Affiliation with OEM Brands

FL Visual LLC is not affiliated with, sponsored by, endorsed by, or officially connected with any motorcycle, watercraft, or powersports manufacturer, including but not limited to:

Yamaha, KTM, Honda, Husqvarna, Kawasaki, Suzuki, Ducati, GasGas, Stark, Triumph, or any other OEM brand.

All manufacturer names and model designations are used strictly for compatibility and identification purposes.

All trademarks remain the property of their respective owners.

5. No Warranty (AS-IS Sale)

All products are sold “AS IS” and “AS AVAILABLE.”

FL Visual LLC expressly disclaims all warranties, including:

Implied warranty of merchantability
Implied warranty of fitness for a particular purpose
Warranty of durability
Warranty of performance in racing or extreme conditions

No guarantee is made regarding:

Product lifespan
Adhesion durability
Color stability
Resistance to racing, fuel, UV, heat, chemicals, crashes, or environmental exposure

Use of products is entirely at the customer’s own risk.

6. Shipping & International Policy Alignment

All shipping terms are governed by our Shipping & Returns Policy.

Customers acknowledge that:

Production time is separate from shipping time
Shipping times are estimates only
FL Visual is not responsible for carrier delays
International customers are responsible for customs duties, VAT, and import taxes
Refused international shipments are not eligible for refund

Shipping costs are non-refundable once an order has shipped.

💳 7. Enhanced Chargeback & Payment Dispute Policy

By placing an order, you agree to the following legally binding payment terms:

Authorized Use

You confirm that:

You are the authorized cardholder
You have permission to use the payment method
All billing information is accurate

Mandatory Resolution Process

You agree to contact FL Visual directly to resolve any issue before initiating:

Chargebacks
Payment disputes
Bank reversals
Payment processor claims

Failure to attempt resolution prior to initiating a dispute constitutes a breach of these Terms.

Evidence & Dispute Enforcement

FL Visual actively disputes fraudulent or abusive chargebacks.

Evidence may include:

IP address logs
Device fingerprinting
Billing & shipping verification
Order confirmation records
Production records
Carrier tracking & delivery confirmation
Customer communications

Abuse of Dispute Process

Improper or fraudulent chargebacks may result in:

Account blacklisting
Permanent refusal of future service
Collection activity
Recovery of dispute fees
Legal action to recover damages and associated costs

You agree that initiating a fraudulent dispute after receiving product constitutes civil fraud.

Agreement to Arbitration (Optional Strong Protection)

To the fullest extent permitted by law, any payment dispute not resolved directly shall be resolved through binding arbitration in the State of Arizona.

8. Limitation of Liability

FL Visual LLC shall not be liable for:

Installation errors
Improper surface preparation
Racing damage
Crash damage
Environmental wear
Loss of profits
Loss of sponsorship
Competitive results
Indirect or consequential damages

Maximum liability shall not exceed the purchase price of the product.

9. Indemnification

You agree to indemnify and hold harmless FL Visual LLC from any claims arising from:

Improper installation
Misuse
Racing participation
Third-party claims related to product use

10. International Compliance

Customers are responsible for ensuring compliance with local laws in their country.

FL Visual makes no representation that products comply with regulations outside the United States.

11. Governing Law

These Terms are governed by the laws of the State of Arizona.

All disputes shall be resolved exclusively in Arizona.

12. Modifications

FL Visual reserves the right to update these Terms at any time.

Continued use of the Site constitutes acceptance of modifications.
